Terms of Service

1. About these Terms

These Terms of Service (the “Terms”) govern your use of the DesireAI service: our Telegram bots, the Telegram mini-application and related pages (together, the “Service”). In these Terms “we”, “us” and “DesireAI” mean the operators of the Service; “you” means the user.

By starting the bot or otherwise using the Service you confirm that you have read and accept these Terms. If you do not accept them, do not use the Service.

2. Eligibility

You may use the Service only if all of the following are true:

• you are at least 18 years old, or older if the age of majority in your jurisdiction is higher;
• you have full legal capacity to enter into a binding agreement;
• viewing sexually explicit material is lawful where you are located;
• you have never been convicted of a sexual offence involving minors.

If we learn that a user is under 18, we terminate access and delete the associated data.

3. Zero tolerance for content involving minors

You must not request, describe, prompt, generate, upload or attempt to obtain any material that depicts or sexualises a person under 18, or a character presented as under 18. This applies to real, fictional and AI-generated material equally, and to any age-suggestive framing (school settings, “teen”, “child”, family-roleplay involving minors, and similar).

We enforce this prohibition through automated and manual moderation, and we do not accept photographs or other files uploaded by users.

Violations result in immediate and permanent termination without refund. We reserve the right to preserve the relevant records and to disclose them to law enforcement and competent authorities where required or permitted by law.

4. AI-generated fictional content

All characters, personas, images, videos, voices and dialogue in the Service are works of fiction generated by artificial intelligence. They do not depict real people, real events or real conduct, and any resemblance to an actual person is unintended and coincidental. Every character is represented as an adult. The Service does not host photographs or videos of real identifiable individuals engaged in sexual conduct.

AI output can be inaccurate or inappropriate. It is entertainment and must not be relied upon as medical, legal, financial, psychological or any other professional advice.

5. Prohibited use

You must not:

• request or attempt to obtain any content described in section 3;
• request or generate content involving non-consent, coercion, incest, bestiality, or real violence, or content promoting terrorism, hatred or self-harm;
• attempt to create material depicting a real identifiable person, or impersonate one;
• use the Service for any unlawful purpose or in breach of local law;
• resell, sublicense or commercially exploit access, or share your account;
• reverse-engineer, decompile, scrape, or interfere with the Service, or bypass technical limits, moderation, geographic restrictions or payment controls;
• use bots or automated tools to interact with the Service.

6. Your account and enforcement

Access is tied to your Telegram account. We may warn, suspend or permanently terminate access, with or without notice, if we reasonably believe you have breached these Terms. Where termination follows abuse of the Service, we are not obliged to refund unused paid periods or unused virtual items.

7. Payments and virtual items

The Service is free to start: you receive a daily allowance of messages at no cost. Paid items are digital, delivered instantly inside the Service, and are the following:

• Subscription for a period — removes the daily message limit and unlocks paid features. Available for one month, three months and one year.
• Message packs — a fixed number of messages beyond the free allowance.
• Crystals — the in-service virtual currency, sold in packs and used to pay for individual features such as animating an image, continuing a video, generating a scenario, voicing a message, saving a character you created, or sending a virtual gift.

The current cost of every item is shown in the Service before you confirm a purchase; the price displayed at that moment applies. Prices, pack sizes and feature costs may change.

8. Renewal and cancellation

The monthly subscription renews automatically. When you buy it with Telegram Stars it is created as a recurring Telegram subscription with a 30-day period: Telegram will attempt to charge the next period automatically until you cancel. You can cancel at any time in Telegram, in the subscription management section of your Telegram account; cancellation stops future charges and your access continues until the end of the period already paid for.

Subscriptions for three months and one year are one-off purchases and do not renew automatically.

If you pay by bank card or SBP, the payment is processed by our payment partner and the renewal and cancellation conditions of that partner apply; you manage or cancel such a subscription through the partner. If the cancellation route is unclear, requests may be submitted to @desireaisupport.

9. Refunds

If a paid feature fails for technical reasons (for example a video, scenario or voice message is not produced), the crystals spent are returned to your balance automatically.

For any other refund request, including statutory rights you may have as a consumer in your country, contact @desireaisupport. Payments made through Telegram or through our payment partner are also subject to their respective refund procedures.

Crystals are a virtual item for use inside the Service only. They are not money, not e-money and not a security; they have no value outside the Service, cannot be exchanged back into currency, transferred to other users or withdrawn.

10. Intellectual property

The Service, its software, characters and generated materials are protected by intellectual property rights. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service and to view content generated for you, for your own private non-commercial entertainment. You may not redistribute or commercially exploit generated content.

11. Disclaimers and liability

The Service is provided “as is” and “as available”. We do not warrant uninterrupted or error-free operation, that generated content will meet your expectations, or that data will never be lost. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, lost profits, or loss of data arising from your use of the Service.

12. Changes to the Service and to these Terms

We may modify, suspend or discontinue features, and we may update these Terms. The current version is always published at this address with its date. Continued use after an update means you accept the updated Terms.

13. Complaints, reports and contact

To report content, request removal of material, raise a payment issue or exercise your rights, contact @desireaisupport. Requests are reviewed within a reasonable time; reports concerning minors or illegal content are handled as a priority.

Before resorting to formal proceedings, the parties shall attempt to resolve the dispute directly.
